1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and 3A Dynamics ("we", "us", "our"), governing your access to and use of the Telemetry Manager desktop software, web platform, and related services (collectively, the "Service").

By creating an account, purchasing a license, or downloading the Telemetry Manager client, you confirm that you are at least 16 years of age and legally competent to enter into this agreement. If you do not agree to these Terms, you must not use the Service.

2. License Grant & Device Activations

Subject to your compliance with these Terms, we grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to install and execute Telemetry Manager solely for your personal, non-commercial sim racing use.

• Device Limits: Each Pro License key permits simultaneous activation on up to two (2) personal devices.
• Device Management: You can view active devices and remotely revoke any device registration through your account dashboard at any time to transfer your license to a new PC.
• Free Version: The free tier of Telemetry Manager is provided at no cost with core telemetry features and no time limit.

3. Prohibited Activities

You agree that you will not, directly or indirectly:

• Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Telemetry Manager binary or licensing validation mechanisms.
• Circumvent, bypass, or tamper with any technological protection or license key authentication protocols.
• Publish, distribute, resell, lease, or publicly share your private license key.
• Use the Service to transmit malicious software, automated scraping bots, or disrupt game telemetry network channels.

We reserve the right to suspend or terminate license keys that are detected to be publicly distributed or utilized in violation of these rules.

4. Game Simulators & "As-Is" Nature

Telemetry Manager interfaces with supported third-party racing simulators (Assetto Corsa and Assetto Corsa Competizione, with planned compatibility for iRacing). We are an independent software development team and are not affiliated with, endorsed by, or sponsored by Kunos Simulazioni, iRacing Motorsport Simulations, or their parent companies.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. While we actively maintain compatibility, we cannot guarantee uninterrupted function immediately following major third-party game patches or operating system updates.

5. Billing & Merchant of Record

All order processing, billing, invoicing, and global tax compliance for Telemetry Manager Pro licenses are handled exclusively by our authorized Merchant of Record, Paddle.

When you purchase a Pro License, Paddle processes your transaction securely under PCI-DSS Level 1 compliance. We do not store, process, or have access to your full credit card numbers, CVVs, or sensitive financial information.

6. 14-Day Refund Policy

We offer a full 14-day money-back guarantee from the date of purchase. If you encounter any technical issues, unsupported hardware, or simulator incompatibility that cannot be resolved, simply contact us at contact@3adynamics.com with your order number for a full refund.

7. Limitation of Liability

To the maximum extent permitted by applicable law, 3A Dynamics and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, hardware malfunction, or gameplay disruptions resulting from the use or inability to use the software.

8. Modifications & Governing Law

We may update these Terms periodically. In the event of material revisions, we will provide notice through our website or client release notes. Your continued use of the Service following such updates constitutes acceptance.
